Conversion of a lease into a land title

This service enables the holder of an administrative contract (lease, building lease or occupation permit) to apply to have their right of use converted into a land title.

Description

This procedure enables the State to transfer ownership of the land to the beneficiary by issuing a land title in the name of the applicant, whether a natural or legal person.

The contracts in question generally relate to land located in areas covered by a town planning scheme.

Target audience

  • Leaseholders;

  • Holders of a right of superficies;

  • Beneficiaries of an occupation permit;

  • Natural persons;

  • Legal entities.

The applicant must submit an application to the Directorate of Registration, Public Property and Stamp Duty, together with the required supporting documents. The application is then examined by the relevant departments and, where appropriate, referred to the ad hoc committee responsible for reviewing applications for transfer.

Required documents

  • A written application addressed to the Director of Registration, Land and Stamp Duty

  • A certified copy of the lease, the lease registration certificate, the building lease agreement or the occupation permit

  • A certified copy of the national identity card or any document proving the company’s legal status, in the case of legal entities

  • A receipt for payment of occupation fees

Steps in the procedure

  • Compile the application file with the required documents

  • Submit the application to the relevant departments of the DEDT

  • Verification and review of the application by the administration

  • Examination of the application by the relevant ad hoc committee

  • Issuance of the land title in the beneficiary’s name, following approval of the procedure
